1. Agreement to these terms

These Terms of Use form a binding agreement between you and MIND SPOT INC, a Florida corporation with its principal address at 3476 Shallow Cove Lane, Clermont, FL 34711, United States ("COVRCAR", "we", "us"). They govern your access to and use of covrcar.com and any related pages, forms, emails, and text messages we operate.

By using the site you accept these terms. If you do not accept them, do not use the site.

2. Eligibility

You must be at least 18 years old and a resident of the United States to use this site. By using it you represent that you meet both conditions and that any information you submit is your own, is accurate, and is submitted with authority.

3. What the service is

COVRCAR provides two things: published market rate information for auto insurance by state and ZIP code, and a request form that allows you to be connected with licensed insurance carriers, licensed agencies, and marketing partners that place business with them.

We are not an insurance company, insurance agency, or insurance broker. We hold no insurance producer licence. We do not underwrite risk, issue policies, quote binding prices, accept premium payments, endorse or cancel coverage, or make any decision about a claim. All of that is done by the licensed third parties you deal with after a referral.

Submitting a request through this site is not an application for insurance, and it does not create any coverage. No coverage exists until a licensed insurer issues a policy to you and you accept it on that insurer's terms.

4. Rate information is an estimate, not a quote

Rate figures published on this site are market averages compiled from publicly available industry rate studies, presented for general information. They are not quotes, offers, solicitations, or guarantees of price, coverage, or eligibility.

Your actual premium depends on your state, garaging ZIP code, vehicle, driving history, coverage selections, discounts, and the underwriting rules of the carrier you choose. It will differ from the figures shown here, sometimes substantially. Rates in the market change frequently and our figures may lag those changes. Do not make a purchase, cancellation, or coverage decision on the basis of the figures on this site alone.

5. Your submission and consent to contact

When you submit a quote request, you authorise us to transmit the information in it to insurance carriers, licensed agencies, and marketing partners so that they may contact you and prepare a quote. Those recipients act independently and are not our agents.

If you tick the telephone consent box, you give prior express written consent to be contacted at the number you provided by us and by those partners, including through an automatic telephone dialing system, an artificial or prerecorded voice, and SMS, even if the number is on a do-not-call registry. Consent is not a condition of purchasing anything. Message and data rates may apply. You may revoke consent at any time as described in our Privacy Policy.

You agree that the information you submit is truthful and complete. Submitting another person's information without their permission, or submitting deliberately false information, is a breach of these terms.

6. Acceptable use

You agree not to:

• Use the site for any unlawful purpose or in violation of any applicable regulation, including insurance, telemarketing, and consumer protection law.
• Submit information about anyone other than yourself without their express authorisation.
• Scrape, harvest, crawl, or systematically extract data or content from the site, or use automated means to submit forms.
• Attempt to interfere with, probe, or circumvent the security of the site or any related system.
• Reverse engineer, decompile, or attempt to derive the source of any part of the service.
• Frame, mirror, or resell any part of the site or its content without our written permission.
• Impersonate any person or misrepresent an affiliation with us or with any carrier.

We may suspend or block access to anyone we reasonably believe is breaching this section.

7. Accounts

Where an account is issued to you, you are responsible for keeping your credentials confidential and for activity that occurs under your account. Tell us promptly at support@covrcar.com if you believe your account has been accessed without authorisation. We may suspend or close an account that has been inactive for an extended period or that is being used in breach of these terms.

8. Intellectual property

The site, including its text, layout, design, graphics, compiled rate tables, and code, is owned by MIND SPOT INC or its licensors and is protected by intellectual property law. The COVRCAR name and logo are our trademarks. You are granted a limited, revocable, non-exclusive, non-transferable licence to access and use the site for your own personal, non-commercial purposes. Nothing else is granted.

Names and marks of insurance carriers that appear on this site belong to their respective owners. Their appearance does not imply endorsement of COVRCAR by them, or by us of them.

9. Third party conduct

We do not control the carriers, agencies, and marketing partners you may be connected with. We are not responsible for their acts or omissions, for the accuracy of any quote they give you, for the terms of any policy they issue, for how they handle a claim, or for how or how often they contact you. Any dispute about a quote, a policy, a premium, or a claim is between you and that party.

10. Disclaimer of warranties

The site and all content on it are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the site will be uninterrupted, timely, secure, error free, or that any information on it is accurate, complete, or current.

Nothing on this site is legal, financial, or insurance advice. Speak to a licensed insurance professional in your state before making a coverage decision.

11. Limitation of liability

To the fullest extent permitted by law, MIND SPOT INC and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost savings, loss of data, or loss of goodwill, arising out of or relating to your use of the site, whether based in contract, tort, strict liability, or any other theory, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for all claims relating to the site will not exceed one hundred United States dollars ($100.00).

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. Where that is the case, the exclusions and limitations above apply only to the extent permitted.

12. Dispute resolution and arbitration

Read this section carefully. It affects your legal rights.

Informal resolution first. Before starting arbitration, you agree to contact us at legal@covrcar.com with a written description of the dispute and the relief you want, and to give us 60 days to resolve it.

Binding arbitration. If the dispute is not resolved, you and we agree that any claim arising out of or relating to these terms or the site will be resolved by final and binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. The Federal Arbitration Act governs the interpretation and enforcement of this section. Arbitration will take place in Lake County, Florida, or, at your election, by telephone, video, or on documents only. An arbitrator may award the same individual relief a court could.

Class action waiver. You and we agree that each may bring claims only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding. The arbitrator may not consolidate claims or preside over any form of representative proceeding.

Exceptions. Either party may bring an individual claim in small claims court, and either party may seek injunctive relief in court to protect intellectual property rights.

30 day opt out. You may opt out of this arbitration agreement by emailing legal@covrcar.com within 30 days of first using the site, with your name and a statement that you are opting out of arbitration. Opting out has no other effect on these terms.

Jury trial waiver. Except where arbitration does not apply, you and we waive any right to a jury trial.

13. Governing law and venue

These terms are governed by the laws of the State of Florida, without regard to its conflict of laws rules. Where a claim is not subject to arbitration, the state and federal courts located in Lake County, Florida have exclusive jurisdiction, and you consent to that venue.

14. Indemnity

You agree to indemnify and hold harmless MIND SPOT INC and its officers, directors, employees, and agents from any claim, demand, loss, liability, or expense, including reasonable legal fees, arising out of your use of the site, your breach of these terms, your submission of another person's information without authorisation, or your violation of any law or third party right.

15. Changes to the service and to these terms

We may change, suspend, or discontinue any part of the site at any time. We may also revise these terms; when we do, we will update the effective date above and, for material changes, post notice on the site. Your continued use after a change takes effect means you accept the revised terms.

16. General

If any provision of these terms is held unenforceable, the rest remains in force and the unenforceable provision will be modified to the minimum extent necessary. Our failure to enforce a provision is not a waiver of it. You may not assign these terms; we may assign them in connection with a merger, acquisition, or sale of assets. These terms, together with the Privacy Policy and Your Privacy Choices, are the entire agreement between you and us regarding the site.
